1. Use of the Site

The Site is provided for your personal, non-commercial use to search for real estate, learn about our services, and contact us. You agree to use the Site only for lawful purposes and in accordance with these Terms.

You agree NOT to:

• Use the Site for any commercial purpose other than evaluating properties for your own potential purchase or lease;
• Copy, scrape, harvest, redistribute, retransmit, or create derivative works from the Site's content or listing data, whether manually or through automated means (including bots, crawlers, and scrapers);
• Falsify, misrepresent, or materially alter any listing information obtained from the Site;
• Interfere with or disrupt the Site, its servers, or networks, or attempt to gain unauthorized access to any portion of the Site;
• Use the Site to transmit any malicious code, spam, or unlawful content;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

2. MLS / IDX Listing Data

Property listing information on the Site is provided through the Internet Data Exchange (IDX) program of the North Texas Real Estate Information Systems, Inc. (NTREIS) and is subject to the following:

• The listing data is provided exclusively for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing or leasing.
• Real estate listings held by brokerage firms other than Sirka Real Estate are marked with the IDX logo, and detailed information about them includes the name of the listing broker.
• Information is deemed reliable but is not guaranteed. All information should be independently verified. Properties may or may not be listed by the office or agent presenting the information.
• Listing data is updated periodically, and changes (including price changes, status changes, and withdrawals) may not be immediately reflected on the Site.
• The listing content is copyrighted by NTREIS and/or the respective listing brokers. Unauthorized reproduction or redistribution is prohibited.

3. No Professional Advice; No Agency Relationship

Information on the Site is provided for general informational purposes only and does not constitute legal, financial, tax, or investment advice. Use of the Site does not create an agency or fiduciary relationship between you and Sirka Real Estate. An agency relationship is established only through a separate written agreement.

Texas law requires all real estate licensees to provide the following:

4. Accuracy of Information

While we strive to keep the information on the Site accurate and current, we make no representations or warranties about the accuracy, completeness, reliability, or timeliness of any content, including listing data, photographs, school information, property measurements, room dimensions, lot sizes, taxes, and fees. Square footage and dimensions are approximate and should be independently verified by buyers. School assignments should be verified directly with the school district.

5. Intellectual Property

The Site and its original content (excluding MLS/IDX data, which is owned by NTREIS and the respective listing brokers) — including text, graphics, logos, the SIRKA name and logo, and the Site's design — are the property of Sirka Real Estate or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or content without our prior written consent.

6. User Accounts

If you create an account on the Site (where available), you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

7. User Submissions

If you submit information through the Site (such as contact forms or messages), you represent that the information is accurate and that you have the right to provide it. Our use of personal information is governed by our Privacy Policy.

8. Third-Party Services and Links

The Site uses third-party services (including mapping and analytics providers) and may contain links to third-party websites, including virtual tours. We do not control and are not responsible for third-party content, services, or privacy practices. Links do not imply endorsement.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SIRKA REAL ESTATE AND ITS OWNERS, AGENTS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Sirka Real Estate and its owners, agents, and employees from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms. Sections of these Terms that by their nature should survive termination shall survive.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Denton County, Texas, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may revise these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the updated Terms on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
